エプスタイン文書とは何か

— 公開が進むほど混乱が生まれる構造 —

米司法省は現在、故 Jeffrey Epstein に関連する文書を段階的に公開している。この文書群は一般に「エプスタイン文書」と呼ばれているが、単一の文書や特定のリストを指すものではない。BBCなどの報道によれば、公開対象には写真、動画、捜査資料、証言記録などが含まれており、事件に関連する膨大な司法資料の集合体である。

今回の公開は、米議会が成立させた Epstein Files Transparency Act に基づくものである。この法律は、エプスタイン事件に関連する政府文書の公開を司法省に義務付けている。

しかし公開は政治問題にもなっている。BBCの報道によれば、法律では2025年12月19日までに文書を公開することが求められていたが、司法省はすべての資料を期限までに公開できなかったと説明している。司法副長官は、なお「数十万ページの文書が審査中で公開されていない」と述べている。

公開された文書の多くは黒塗り（redaction）されている。法律上、黒塗りできるのは被害者の身元や進行中の捜査に関する情報などに限られるが、大量の黒塗りがあること自体が批判の対象となっている。

一方、ウォール・ストリート・ジャーナルの調査は、公開文書の中に欠落ファイルがある可能性を指摘した。同紙の分析によると、公開資料の中で4万件以上のファイルが見当たらない可能性があり、司法省は「47,635件のファイルが追加審査のため公開から外されている」と説明した。

未公開文書の中には、FBI捜査官が証人との面談内容をまとめた「Form 302」と呼ばれる記録も含まれている。これらの文書にはエプスタイン事件に関する証言が記録されており、ウォール・ストリート・ジャーナルはその中に Donald Trump に対する未確認の性的行為の申し立てを含む記録があると報じている。ただし記事は、その内容が「未確認の主張」であることを明確にしている。トランプは不正行為を否定している。

エプスタイン文書をめぐる議論が混乱しやすい理由は、この文書群の性質にある。公開されている資料の多くは裁判で事実認定された証拠ではなく、捜査過程で収集された資料である。たとえばFBIのForm 302は、捜査官が証人の話をまとめた記録であり、宣誓証言や裁判記録とは性質が異なる。

BBCの記事もこの点を強調している。公開文書には多くの著名人の名前や写真が含まれているが、文書に名前が登場することや写真に写っていること自体は、不正行為を意味するものではない。

つまりエプスタイン文書とは、裁判の結論を示す文書ではなく、事件に関連する膨大な捜査資料の公開である。そこには証言、写真、メール、捜査メモなど多様な資料が含まれており、その中には未確認の情報も存在する。

さらに法律は文書公開を義務付ける一方で、被害者保護や進行中の捜査への影響を防ぐための制限も設けている。そのため、どこまで公開するかという判断が常に必要となる。

この制度構造のため、文書公開が進むほど新しい情報が追加される一方で、真偽が確定していない証言や断片的な資料も増えていく。結果として、エプスタイン文書は透明性を高める試みであると同時に、情報解釈の混乱を生みやすい性格も持っている。

現時点で確実に言えるのは、エプスタイン文書は単一のリストではなく、事件に関連する巨大な捜査アーカイブであり、その公開は現在も進行中であるということである。

What Are the Epstein Files?

— Why Their Release Is Likely to Create More Confusion —

The U.S. Department of Justice is currently releasing documents related to the case of the late convicted sex offender Jeffrey Epstein in several stages. These materials are widely referred to as the “Epstein files,” but they do not represent a single document or a specific list. According to reporting by BBC News, the files include photographs, videos, investigative records, and witness statements, forming a vast collection of judicial and investigative materials connected to the case.

The release is being conducted under the requirements of the Epstein Files Transparency Act passed by the U.S. Congress. The law requires the Department of Justice to make public government records related to the Epstein investigation.

However, the process has already become politically contentious. According to BBC reporting, the law required documents to be released by December 19, 2025, but the Department of Justice stated that it could not release all materials by that deadline. The deputy attorney general said that “several hundred thousand pages” of documents were still under review and had not yet been made public.

Many of the documents that have been released are heavily redacted. Under the law, redactions are permitted only to protect the identities of victims or information related to ongoing investigations. Nevertheless, the extensive redactions themselves have drawn criticism.

Meanwhile, an analysis by The Wall Street Journal suggested that some files were missing from the public release. According to the newspaper, more than 40,000 files appeared absent from the Justice Department’s online archive. The department later stated that 47,635 files had been taken offline for additional review before being republished.

Among the unreleased materials are FBI interview summaries known as “Form 302.” These documents record statements given by witnesses to investigators. The Wall Street Journal reported that some of the records contain allegations of sexual misconduct involving Donald Trump. However, the newspaper explicitly described these statements as “unverified allegations.” Trump has denied wrongdoing.

One reason the Epstein files create confusion is the nature of the documents themselves. Many of the materials are investigative records rather than evidence formally established in court. For example, an FBI Form 302 is a summary written by investigators documenting what a witness said, and it differs from sworn testimony or court findings.

BBC reporting also emphasized that many well-known figures appear in the files or photographs. However, the presence of a name or image in the documents does not indicate wrongdoing.

In essence, the Epstein files do not represent the final conclusions of a trial but rather the public release of a vast investigative archive related to the case. The materials include witness statements, photographs, emails, and investigative notes, some of which contain claims that have not been verified.

Moreover, while the law mandates transparency, it also requires the protection of victims and safeguards against compromising ongoing investigations. As a result, authorities must continuously determine what can and cannot be released.

Because of this structure, the more documents are released, the more new information becomes available—but also the more unverified claims and fragmented records appear. The Epstein files therefore represent both an effort toward transparency and a source of ongoing interpretive confusion.

What can be stated with certainty at this stage is that the Epstein files are not a single list but a massive archive of investigative materials related to the case, and their public release is still ongoing.
